If you are arrested or are the subject of a police investigation, you need to immediately speak to, meet with and hire a lawyer. Criminal charges in Pennsylvania are serious. The police, although they may act friendly, are not looking out for your best interests.
You have rights that cannot be taken away, however, you need to know what those rights are and how to ask for them. The police, the prosecutor or the judge will not take steps to protect your rights. You need to take action.
If you are convicted of criminal charges you face jail time or years of supervision by the probation department. You will have a permanent criminal record for the majority of your life.
If you are arrested or are the subject of a police investigation, DO NOT:
> Provide a statement to the police
> Tell your side of the story
> Consent to a search of your house, your person or your car
> Believe that your silence can be used against you
If you remain silent or refuse to provide information regarding an investigation, you may be told that you will be charged with Obstruction of Justice. You can’t. If you refuse to consent to a search the police may tell you that they will get a warrant. Make them.
It is not your job to do the investigation. It cannot be held against you if you politely tell the police that you want to remain silent or you would feel more secure if they went to get a search warrant.
